Surat Pernyataan Pembebasan dan Pelepasan dari Tuntutan (SP3T) Pocari Sweat Bandung West Java Marathon 2017 

SEMUA PESERTA HARUS MEMBACA DAN MENANDATANGANI. BACALAH DENGAN CERMAT SEBELUM MENANDATANGANI SURAT PERNYATAAN, PEMBEBASAN DAN PELEPASAN DARI TUNTUTAN (SP3T).

Saya mengakui bahwa kegiatan ini adalah kegiatan yang menguji batas-batas fisik dan mental dengan disertai potensi kematian, cedera serius, dan kerugian harta benda. Dengan ini, Saya MENYATAKAN MENANGGUNG RISIKO DARI BERPARTISIPASI DALAM KEGIATAN TERSEBUT DI ATAS.

Saya menyatakan bahwa saya sehat secara fisik, telah cukup terlatih untuk berpartisipasi dalam kegiatan ini, dan belum disarankan sebaliknya oleh seorang profesional medis yang berkualitas (Dokter).

Dengan ini saya mengambil tindakan berikut untuk diri sendiri, wali, pencatatan hukum, ahli waris, kerabat terdekat, penerus dan penerima, atau orang lain yang mungkin mengklaim atau menuntut atas nama saya, dan saya tegas mengakui bahwa saya dengan niat sendiri akan bertindak seperti di bawah ini:

(A) SAYA SETUJU untuk mematuhi seluruh peraturan dalam kegiatan ini.

(B) Saya SETUJU bahwa sebelum berpartisipasi dalam sebuah kegiatan, saya akan memeriksa arena lomba, fasilitas, peralatan, dan daerah yang akan digunakan dan jika saya meyakini akan adanya ketidakamanan, saya akan menyarankan orang untuk mengawasi acara, kegiatan, fasilitas, atau daerah tersebut;

(C) SAYA MELEPASKAN DAN MEMBEBASKAN SEMUA KLAIM, KERUGIAN, ATAU KEWAJIBAN UNTUK KEMATIAN, CEDERA PRIBADI, ATAU SEBAGIAN CACAT TETAP, KERUSAKAN PROPERTI, MEDIS ATAU TAGIHAN RUMAH SAKIT, PENCURIAN ATAU KERUSAKAN APAPUN, TERMASUK KERUGIAN EKONOMI (RUGI) DAN/ATAU KEHILANGAN BARANG, YANG MUNCUL DARI ATAU BERHUBUNGAN DENGAN PARTISIPASI SAYA, ATAU SAYA BEPERGIAN KE DAN DARI KEGIATAN TERSEBUT DI ATAS, PADA ORANG-ORANG ATAU BADAN BERIKUT: Mesarace, Penyelenggara acara, sponsor, Race Director, karyawan, pemilik acara, relawan, negara, kota, atau daerah di mana peristiwa atau segmen acara diadakan, dan petugas, direktur, karyawan, perwakilan, relawan, dan agen dari apapun di atas bahkan jika klaim tersebut, kerugian, atau kewajiban yang disebabkan oleh tindakan lalai atau kelalaian dari seseorang, saya dengan ini membebaskan segala tuntutan atas tindakan yang disebabkan oleh kelalaian dari setiap orang atau badan lainnya;

(D) Saya MENGAKUI bahwa akan ada lalu lintas kendaraan pada jalur, dan saya MENANGGUNG RISIKO DARI IKUT DAN BERPARTISIPASI DALAM KEGIATAN INI. Saya JUGA BERTANGGUNG JAWAB ATAS SEGALA RISIKO LAIN terkait dengan berpartisipasi dalam acara ini termasuk pada jatuh, kontak dan/atau bertabrakan dengan peserta lain, efek cuaca termasuk panas dan/atau kelembaban, peralatan yang rusak, kondisi jalan (dan perlintasan kendaraan, kereta api, jembatan, underpass), bahaya air, dan setiap bahaya yang mungkin ditimbulkan oleh penonton atau relawan; semua risiko tersebut saya pahami dan kenali, dan saya juga tahu bahwa risiko ini termasuk risiko yang mungkin disebabkan oleh kelalaian personal atau badan yang disebutkan di atas dalam ayat (c) atau orang atau badan lain;

(E) Saya SETUJU UNTUK TIDAK MENUNTUT SALAH SATU ORANG ATAU BADAN YANG DISEBUTKAN DI ATAS, DALAM AYAT (c) untuk setiap klaim, kerugian, atau kewajiban yang dengan ini telah saya bebaskan dan berhentikan;

(F) Saya secara pribadi menanggung kerugian dan membebaskan ATAS ORANG DAN BADAN YANG DISEBUTKAN DALAM AYAT (c) untuk setiap dan semua klaim yang dibuat atau kewajiban yang dinilai terhadap mereka sebagai akibat dari (i) tindakan saya atau reaksi, (ii) tindakan, reaksi atau kelalaian orang lain, termasuk pihak-pihak terkait dengan ganti rugi ini, (iii) kondisi fasilitas, peralatan, dan/atau daerah di mana acara ini berlangsung, (iv) Peraturan kompetitif, atau (v) setiap kerugian lain yang disebabkan oleh kejadian yang berkaitan dengan acara ini dan

(G) Saya MENGIZINKAN penggunaan nama saya, gambar, suara, pernyataan atau yang berkaitan dengan partisipasi saya di acara ini dalam bentuk media apapun, dan saya melepaskan semua hak untuk kompensasi masa depan yang saya mungkin dapatkan sebagai hak atas penggunaannya;

(H) Saya MENGERTI dan menerima bahwa biaya pendaftaran saya tidak dapat dikembalikan dalam keadaan apapun termasuk pembatalan acara untuk masalah keamanan atau sebagai akibat dari sesuatu di luar kendali yang wajar dari Penyelenggara, termasuk dan tak terbatas pada angin kencang, hujan deras, banjir, petir dan kecelakaan.

(I) Saya SETUJU dengan syarat dan ketentuan yang tertera pada website acara.

 

Pocari Sweat Bandung West Java Marathon 2017 ACKNOWLEDGMENT, WAIVER AND RELEASE FROM LIABILITY

 

ALL ATHLETES MUST READ AND SIGN. PLEASE READ CAREFULLY BEFORE SIGNING THE ACKNOWLEDGMENT, WAIVER AND RELEASE FROM LIABILITY (AWRL).

I acknowledge that this event is a test of a person physical and mental limits and it carries with it potential for death, serious injury, and property loss. I HEREBY ASSUME THE RISKS OF PARTICIPATING IN THIS EVENT AS MENTIONED ABOVE.

I certify that I am physically fit, have sufficiently trained for participation in this event, and have not been advised otherwise by a qualified health professional.

I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns, or anyone else who might claim or sue on my behalf, and I expressly acknowledge that it is my intent to take these actions:

(a) I AGREE to abide by the competitive rules adopted by this event.

(b) I AGREE that prior to participating in an event, I will inspect the racecourse, facilities, equipment, and areas to be used and if I believe any to be unsafe I will advise the person supervising the event, activity, facility, or area;

(c) I WAIVE, RELEASE, AND DISCHARGE FROM ANY AND ALL CLAIMS, LOSSES, OR LIABILITIES FOR DEATH, PERSONAL INJURY, PARTIAL OR PERMANENT DISABILITY, PROPERTY DAMAGE, MEDICAL OR HOSPITAL BILLS, THEFT OR DAMAGES OF ANY KIND, INCLUDING ECONOMIC LOSSES (AND LOSS) AND/OR STOLEN ITEMS, WHICH ARISE OUT OF OR RELATE TO MY PARTICIPATION IN, OR MY TRAVELING TO AND FROM THE EVENT, THE FOLLOWING PERSONS OR ENTITIES: MESARACE, sponsors, race directors, employees, event owners, volunteers, all states, cities, or localities in which events or segments of events are held, and the officers, directors, employees, representatives, volunteers, and agents of any of the above even if such claims, losses, or liabilities are caused by the negligent acts or omissions of the persons I am hereby releasing or are caused by the negligent acts of any other person or entity;

(d) I ACKNOWLEDGE that there will be traffic on the course route, and I ASSUME THE RISKS OF RUNNING AND PARTICIPATING IN THIS EVENT. I ALSO ASSUME ANY AND ALL OTHER RISKS associated with participating in this event including but not limited to falls, contact and/or crashes with other participants, effects of weather including heat and/or humidity, defective equipment, the condition of the roads (and railroad crossings), water hazards, complications from color on clothing and person, and any hazard that may be posed by spectators or volunteers all such risks being known and appreciated by me, and I further acknowledge that these risks include risks that may be the negligence of the persons or entities mentioned above in paragraph ( c ) or other persons or entities;

(e) I AGREE NOT TO SUE ANY OF THE PERSONS OR ENTITIES MENTIONED ABOVE IN PARAGRAPH ( c ) for any of the claims, losses, or liabilities that I have waived, released or discharged herein;

(f) I INDEMNIFY AND HOLD HARMLESS THE PERSONS AND ENTITIES MENTIONED IN PARAGRAPH ( c ) for any and all claims made or liabilities assessed against them as a result of

(i) my actions or inactions, (ii) the actions, inactions or negligence of others including those parties hereby indemnified; (iii) the conditions of the facilities, equipment, or areas where the event is being conducted; (iv) the Competitive Rules; or (v) any other harm caused by an occurrence related to the Sentul Marathon event; and

(g) I GRANT PERMISSION for the use of my name, image, voice, statement or otherwise relating to my participation in Sentul Marathon event in any form of media, and I waive all right to any future compensation to which I may otherwise be entitled as a result of the use of any of these;

(h) I UNDERSTAND and accept that my entry fee is non-refundable under any circumstance including the cancellation of the Event for safety concerns or otherwise as a result of something beyond the reasonable control of the event organizers, including without limitation strong winds, heavy rain, lightning and accidents. 

(i) I AGREE to the Terms of Service that is available on the official website.
